South Dakota Divorce Laws
In South Dakota you must be a resident of the state on the day you file for divorce. Grounds are based on irreconcilable differences or "fault" which much be proved and is considered adultery, extreme cruelty, desertion, willful neglect, habitual intemperance and conviction of a felony. Fault can effect property division and alimony. There is a 60-day waiting period before the divorce can be finalized.
South Dakota Divorce Education Classes
Co-parenting classes for divorce are required in Lincoln and Minnehaha Counties. These counties require that parents attend the SMILE program. If you are mandated to take a divorce education class in another county or simply want to learn new skills, you can ask your judge, probation officer, or social worker if you can take the class online rather than going to in-person classes. Once approved, our online classes cover a wide range of topics including effective communication skills, the impact of divorce on children, stress and anger management, setting boundaries, rewards and consequences, conflict resolution and how to co-parent as a team.
