North Carolina Divorce Laws
North Carolina is a no-fault state. In order to file for a divorce, you or your spouse must have lived in the state for the 6 months preceding the filing. North Carolina has instituted the method of a "collaborative divorce" which many couples find easier and better for the children in the long run. Utilizing this strategy, divorcing parents negotiate a resolution with the assistance of specialized attorneys, neutral party financial specialists and/or divorce coaches. All information is put clearly on the table. Once the collaborative divorce process begins, lawyers involved can't represent the parties in a contested legal proceeding if the process doesn't work out.
Session Law 1999-237 House Bill 168 Section 17.16
Parents going through a divorce can be asked to take a parent education program designed to develop empathy for their children during and after the separation. This 4 hour program helps caregivers to learn about the legal process and learn how to work as a team for the child's best interest. Parents interested in taking this program online rather than in-person should get prior approval from their judge, probation officer or through their attorney.
North Carolina Student Review
"After years of conflict and stress, my husband and I finally decided to get a divorce even though we were very concerned about how it would affect our kids. This program helped us to learn the skills we needed to get past our animosity and co-parent as a team instead of constantly working against each other. It drove home the importance of our stable relationship for the long-term success of our kids. I highly recommend taking this online program to help reduce the additional strain of getting to a weekly class when you are working and trying to manage a family!" Jill B. - Morrisville, NC
