New York Divorce Laws
To file for a divorce in New York, at least one spouse must have lived in the state for the one year prior to filing. There are 7 grounds for divorce which include:
1. abandonment = your spouse leaves you for at least one year without any intention of returning.
2. imprisonment = if your spouse is in jail for 3 or more years.
3. adultery = you can't testify to this, so you must have a witness.
4. cruel and inhuman treatment = if your physical or mental health has recently been in danger.
5. decree of separation = if you have acquired this judgement from the court for at least one year.
6. separation agreement = the two of you haven't lived together for at least one year and have both signed an agreement about this.
7. irretrievable breakdown = you simply can't repair your relationship and this has been going on for at least 6 months.
