New Jersey Divorce Laws

According to a 2013 American Community Survey, New Jersey has among the lowest divorce rate in the nation. This might be because it's never been easy to get divorced in this state. To file for an absolute divorce or dissolution of a civil union, at least one spouse must be a resident for 1 year prior to taking action. Divorce will be granted based on proof of adultery, extreme cruelty, alcohol or drug addiction for at least 12 months preceding the filing, institutionalization for mental illness, living separately for at least 18 months, imprisonment for at least 18 months or deviant sexual conduct. Couples can also apply for a "no fault" divorce siting irreconcilable differences. It can be expensive to make it through a litigated divorce, sometimes costing more than $10,000.

New Jersey Family Collaborative Law Act

Governor Chris Christie made New Jersey the 9th out of 11 states to legitimize a quicker, less expensive and forward thinking approach to divorce. Each party selects an attorney and agrees to work outside of the court system to reach a settlement. It's for people who value their privacy and don't want everything played out in court and want to work together for the sake of the children on a post-divorce relationship. Instead of having the judge make decisions, divorcing couples work closely with their attorneys, their own mental health counselors and a financial expert to facilitate conflict management and compromise.

N.J.S.A. 2A: 34-12 New Jersey Parent Education Act

This act mandates that parents going through a divorce with children under the age of 18 must attend a co-parenting class. It's designed to remind parents to put the needs of their children first and teach them how to best handle the stress and emotions during this difficult time. Parents are taught effective communication skills, the logistics of the legal process and how to set up a parenting plan. If you are a busy parent with work, school and family obligations or with health issues, and find it difficult to make it to a weekly in-person class, please get prior approval from your judge to take an online program to fulfill this court requirement.
