Divorce Laws in Idaho

Surprisingly, some reports show that Idaho ranks as high as 5th in the nation for the divorce rate. Some attribute this to the high number of marriages at a younger age than the rest of the country. To file for a divorce in Idaho, the filer must have lived in the state for at least 6 weeks prior to beginning the proceeding. After this there is a 20 day cooling off period until any action can be taken by the court. If children are involved, the court will consider the parent's wishes for custody as well as the child's. If the children are living with a grandparent in a comfortable and stable situation, then the court will recognize the grandparent at the same level as the parents for custody rights.
