If you are getting a divorce in Georgia, you must attend a parenting class and file the Certificate of Completion with the court. Georgia Divorce Laws
To file for divorce, one parent must be a resident of the state for 6 months prior to the filing. If the two of you can agree on all issues, the divorce can be granted in as quickly as 31 days after filing. If you go to trial, it can take months and even years. Under O.C.G.A. § 19-9-1, every divorce, custody matter or modification requires that the parents put together a formal Parenting Plan. This plan defines who the primary caregiver is, who the children live with, who has final decision-making authority, education decisions, travel, religious and basic medical issues. It should also define what other adults are allowed to assist in the childcare, extracurricular activity responsibilities and even how often the joint legal custodian can text, email or call the child. A child who is 14 or older has the right to decide with whom he/she wants to live with unless the judge overrides this request because it isn’t in the best interest of the child.
